Terms and Conditions & Full Liability Waiver
By accessing, registering for, purchasing, or using any services provided by Vesta Capital, you agree to be legally bound by the following terms:
1. No Advice: Educational Use Only
All information, content, software, and communications provided by Vesta Capital are strictly for informational and educational purposes only and do not constitute financial, investment, legal, or tax advice. Nothing provided should be interpreted as a recommendation to buy, sell, or hold any financial instrument.
2. Extreme Risk Disclosure
You expressly acknowledge that trading financial markets is highly speculative and carries an extreme risk of loss, including the possible loss of 100% or more of your capital. You fully understand that losses may exceed deposits and agree to assume all risks entirely and without exception.
3. Sole Responsibility
All trading decisions are made exclusively by you. Vesta Capital has no control over your actions and bears zero responsibility for any outcomes resulting from your trading activity.
4. No Guarantees Whatsoever
Vesta Capital makes no representations or warranties of any kind, express or implied, regarding accuracy, completeness, or reliability of information, profitability of any strategy, or future performance of any trade or market. All performance shown is hypothetical and backtested.
5. Absolute Limitation of Liability
To the maximum extent permitted by law, Vesta Capital, its owners, directors, employees, contractors, and affiliates shall not be liable under any circumstances, including negligence, for any financial losses (including total loss of funds), loss of profits, revenue, or opportunity, direct, indirect, incidental, punitive, or consequential damages, errors, omissions, delays, or failures in service delivery, or system outages, technical failures, or third-party issues.
6. Indemnification
You agree to fully indemnify, defend, and hold harmless Vesta Capital and its affiliates from any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from your use or misuse of the service, your trading activity, or your violation of these terms.
7. No Fiduciary or Advisory Relationship
You acknowledge that no fiduciary, advisory, or professional relationship exists between you and Vesta Capital under any circumstances.
8. "As-Is" Service Disclaimer
All services are provided "as is" and "as available", without warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
9. No Reliance Clause
You agree that you have not relied on any statements, representations, or guarantees made by Vesta Capital in deciding to use the service or engage in trading.
10. No Refund Policy (Strict)
All payments made to Vesta Capital are final and non-refundable under all circumstances, including but not limited to dissatisfaction, lack of usage, or trading losses.
11. Subscription Terms
Where services are offered on a subscription basis, by subscribing you authorize automatic recurring billing until cancellation. You are responsible for managing your subscription and cancellation.
12. Cancellation Policy
You may cancel your subscription at any time. Cancellation only applies to future billing cycles. No partial refunds or prorated refunds will be issued for any unused time.
13. Chargebacks & Disputes
Initiating a chargeback or payment dispute without valid legal grounds constitutes a breach of these terms. Vesta Capital reserves the right to pursue legal action, recover fees, and permanently terminate access to services.
14. Jurisdiction & Compliance
You are solely responsible for ensuring that your use of the service complies with all applicable laws and regulations in your jurisdiction.
15. Age & Capacity
You confirm that you are of legal age and have the full legal capacity to enter into this agreement.
16. Binding Agreement
By creating an account, purchasing, or using the service, you irrevocably agree to these terms in full. If you do not agree, you must not use the service under any circumstances.
17. Arbitration Agreement
You agree that any dispute, claim, or controversy arising out of or relating to your use of Vesta Capital or these Terms shall be resolved exclusively through final and binding arbitration, rather than in court. Arbitration shall be conducted on an individual basis only. You waive any right to a trial by judge or jury.
18. Class Action Waiver
You agree that any claims or disputes must be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You expressly waive any right to participate in a class action lawsuit or class arbitration against Vesta Capital.
